Welcome to TheaterSeatingStore ("TSS"). We specialize in Home Theater Seating. This Terms and Conditions govern the use by you of this site. All orders accepted herein are fulfilled by TSS and/or our affiliate companies, which is subject to all of the provisions of the Terms and Conditions. Please read this carefully before using this site. By using this site, you signify your assent to the Terms and Conditions. If you do not agree to the Terms and Conditions, you may not access or otherwise use this site. This does not apply to any transaction or relationship between the parties that is not related to the use of this website and/or the purchase and sale of merchandise through this website.
TSS is not responsible for any product or service, including any claims of quality or performance made on or through any site to which this site links to. TSS expressly disclaims any responsibility for the content, legality, decency or accuracy of any information, and for any products and services, that appear on any linked site.
TSS is providing this site, www.TheaterSeatingStore.com, and its contents on an "as-is" basis. TSS and its officers, directors, employees, agents, licensors, suppliers, content providers and the like (together, "affiliates") make no representations or warranties of any kind, express, with respect to this site or its contacts, including without limitation the products, information or service offered or sold on or through this site or any linked website and the uninterrupted and error-free use of this site. TSS and its affiliates expressly disclaim all such representations and warranties, including without limitation all warranties of merchantability, accuracy, timeliness, completeness, fitness for a particular purpose and non-infringement. TSS and its affiliates do not warrant that the site or files available on the site will be free from corrupted data, computer viruses or similar destructive or contaminating code. No oral or written statements by TSS and its affiliates will create any warranty not expressly set forth herein. Your use of this site and any linked website is at your sole risk.
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase; inaccuracies or errors in product or pricing information; or problems identified by our credit and fraud avoidance group. We may also require additional verifications or information, including but not limited to a credit card authorization form, before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card has been charged, we will issue a credit to your credit card in the amount of the charge. TSS strictly follows all national and international regulations regarding the sale, purchase, and shipment of any product that is considered restricted or prohibited by any law within the United States or abroad.
Refunds can be in the form of store credit, exchanges, or money. Refunds will be issued only within 14 days of receipt of product. All returned product must have a "Return Authorization Number" ("RA") before we will accept the product back. Shipping is nonrefundable. Should the customer want to return any product, it is their responsibility to pay for the return shipping including insurance coverage, equal to the value of the chairs. A 25% restocking fee will be imposed on all returned product, regardless of reason. Monetary refunds are issued using the same form that the order's payment was made in. If you decide to cancel your order for any reason, we reserve the right to subtract credit card transaction fees of 5%, any shipping charges, and restocking fees of 25% from your refund amount. Orders must be canceled within 24 hours of the time your order is placed (unless state law specifies differently). Orders cannot be canceled or returned after they have been processed and/or shipped. We reserve the right to exchange product rather than issuing a refund. If you refuse an exchange offered, a 25% restocking fee will be imposed on all products.
A special order cannot be cancelled or returned. Special orders are non-refundable with the exception of manufacturing defects. Any product ordered which is not in stock, drop-shipped, remanufactured, or of a leather product is considered a special order.
All International orders, and order shipped outside the 48 contiguous US including but not limited to; Hawaii, Alaska, Puerto Rico cannot be returned or refunded. All such orders will incur higher shipping costs, and longer lead time.
If you damage the product and it is in non-resell able condition we will not accept it back for a refund, exchange, or credit. Original packaging may be required in order for a refund to be given. This judgment is to be determined solely by the seller.
You must inspect product at time of delivery. If any of the product is missing or damaged you must call us immediately so we can correct the problem in a timely manner. If the packaging is damaged have the delivery person make note of the damage in writing on the delivery receipt and their paperwork. You have the right to refuse any damaged product you receive from the shipper. At the time of delivery, if you receive damaged product you MUST call us immediately at 972 774 8071, leave a message if it is during non-business hours, including your daytime telephone number where you can be reached.
Customer and/or end user takes full responsibility for the safe installation and use of the chairs. We, the seller, cannot be held liable or responsible for injuries incurred by poor installation or use of the chairs provided from us.
All shipping and delivery dates and times are approximate. We cannot guarantee delivery dates. We are not responsible for delays in shipping transit times due to the shipper / carrier. We cannot be held responsible for delay beyond our control, such as, but not limited to product availability, manufacturing delays, shipping delays, availability and/or accessibility of delivery trucks, chair inspection and cleaning, weather, etc. Customer understands that product(s) can be shipped out in more than one shipment resulting in a partial order being delivered.
The prices displayed on the site are quoted in U.S. Dollars and are valid and effective only within the 48 contiguous United States, and such prices do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price. You are responsible for the payment of any shipping and handling charges and state and local sales or use taxes that may apply to your order. International shipment rates vary based on total package weight and final destination. All pricing does not include duties, insurance costs, tariffs, or value-added taxes. If assessed, these charges are the responsibility of the package recipient, who will be billed for them by the local Customs office.
Description of products
Your product may be slightly different that the pictures displayed in our brochures, catalogs, our web site and our affiliate web sites. Every computer monitor will show differently and there could be variations in color from what is shown on the screen.
Used, refurbished, and/or remanufactured chairs ordered may contain parts of a different style or color than shown on our website. We cannot guarantee that we will be able to fill all of customer's requests. Modifications to the shape and design of the chair model and accessories can occur without notice. We the seller reserve the right to adjust the design of the chair. Fabric, paint, etc. may vary slightly from the product to product. Used chairs could show some signs of wear. Scratches, worn fabric, soiled, and rust may be visible on our chairs sold "as-is". We will do our best to describe the condition of these chairs. We will not intend to sell a chair in better condition than it appears.
Leather is a natural material, marks, scars, and/or blemishes can occur in the material and are not considered a defect. The dyes used in coloring leather can take to the leather differently producing different shades of color. Leather is considered a natural product therefore; these variations are not considered a defect. We will not accept returns on leather due to imperfections in appearance and or color.
We work hard to provide accurate product and pricing information. However, errors may occur. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, SeatsAndChairs.com, Inc. shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. If an item is incorrectly priced, we will either contact you for instructions or cancel your order and notify you of such cancellation. Prices and availability are subject to change without notice.
Purchaser must provide accurate personal information; such as correct billing and shipping address, contact information, and credit card or payment information. Purchaser is responsible if someone other than himself receives or refuses to receive product when delivery is made or attempted by carrier. Refused product will incur additional charges to the buyer, including but not limited to restocking fees, additional shipping fees, storage fees, and/or reimbursement of credit card processing fees, etc.
Acceptance is defined by, but not limited to, any one of the following criteria: a. 4-days have passed since product was delivered; b. Product has been used; c. Product has been installed; d. The outstanding balance due, has been paid.
You agree: "I am the cardholder of the credit card that is being used for this transaction, or I have permission of the cardholder to use his/her card for this transaction. I authorize my household members and/or co-workers to sign for, accept, and receive the shipped product, in my name. I have had all my concerns and questions answered before my purchase by contacting TheaterSeatingStore at the contact information displayed on the web site."
We are not responsible if the customer has failed to read and understand the terms and conditions. You agree, as the consumer you understand what you are purchasing whether you purchase on-line, over the telephone, or in person. Please email us with any questions what so ever, BEFORE you order. An educated consumer is our best customer.
